TERMS AND CONDITIONS OF THE NESTROVIA ONLINE STORE

§ 1. Definitions
  1. Seller/Service Provider – Ihar Shabalouski, operating the business under the legal name NEVQ, registered in the Central Register and Information on Economic Activity (CEIDG) of the Republic of Poland, Legal address - Poland, Warsaw, Ul.   2. Store – The online platform operating under the domain nestrovia.com, through which the Seller offers interior design items, upholstered furniture, and related decor.
  3. Customer – Any natural person, legal entity, or organizational unit without legal personality granted legal capacity by statute, entering into a distance contract with the Seller.
  4. Consumer – A natural person concluding a legal transaction with the Seller not directly related to their business or professional activity, pursuant to Article 22 of the Polish Civil Code. Furthermore, pursuant to Article 7aa of the Polish Consumer Rights Act, provisions concerning Consumers apply equally to a natural person concluding a contract directly related to their business activity (sole proprietorship), provided the contract does not possess a professional character for that person.
  5. Product – Any movable physical good presented in the Store, specifically including but not limited to custom-designed upholstered furniture, ready-to-ship interior decor, and office furnishings subject to the General Product Safety Regulation (GPSR).
  6. Distance Contract – A sales contract concluded between the Customer and the Seller without the simultaneous physical presence of the parties, utilizing one or more means of distance communication.
  7. Omnibus Directive – Directive (EU) 2019/2161, specifically regarding the obligation to present transparent price reductions and verify the authenticity of consumer reviews.
§ 2. General Provisions and Electronic Services
  1. These Terms and Conditions dictate the rules for using the Store, placing orders for Products, delivering ordered Products, paying the sale price, the Customer's right to cancel the contract, and the rules for filing and processing complaints.
  2. The Seller fulfills all pre-contractual information obligations stipulated by Article 12 of the Polish Consumer Rights Act directly within these Terms and Conditions and on the respective Product pages prior to the conclusion of any contract.
  3. To fully utilize the Store, the Customer must possess an active email account, a stable internet connection, and a modern web browser configured to accept cookies in accordance with the Store's Privacy Policy.
  4. The Seller utilizes advanced cryptographic protocols to ensure the security of data transmission. However, the Customer acknowledges the inherent risks associated with data transmission over the public Internet.
§ 3. Pricing, Promotions, and The Omnibus Directive
  1. All prices displayed in the Store are gross prices presented in the selected currency, inclusive of the applicable Value Added Tax (VAT). Prices do not include delivery and freight costs, which are calculated dynamically during checkout based on the volume, weight of the bulky furniture, and the destination address.
  2. Transparency of Price Reductions: In strict compliance with the Polish implementation of the EU Omnibus Directive and the regulatory guidelines of the Office of Competition and Consumer Protection (UOKiK), any announcement of a price reduction within the Store will be accompanied by a clear, textual explanation indicating the lowest price applied for that Product during the 30 days preceding the reduction.
  3. The lowest 30-day price will be displayed prominently alongside the discounted price on the listing page, the product subpage, and at checkout, ensuring complete transparency and mitigating artificial price inflation.
§ 4. Order Placement and Contract Conclusion
  1. Orders may be placed electronically 24 hours a day, 7 days a week.
  2. The Customer initiates an order by configuring and adding a Product to the virtual shopping cart. For bespoke or customized upholstered furniture, the Customer must specify parameters (e.g., fabric type, dimensions, finish) prior to adding the item to the cart.
  3. By clicking the button bearing the explicit statutory wording "Order with obligation to pay" (Zamówienie z obowiązkiem zapłaty), the Customer makes a legally binding offer to purchase the selected Products.
  4. Upon receipt of the order, the Seller shall immediately send an electronic confirmation to the Customer's provided email address. The Distance Contract is legally concluded upon the Customer's receipt of this order confirmation email.
  5. In accordance with Polish tax law, including the implementation of the National e-Invoicing System (KSeF) effective February 2026, the Seller shall issue and deliver structured electronic invoices to the Customer.
§ 5. Financial Infrastructure and Payment Methods
  1. The Seller utilizes Stripe as the primary, secure payment gateway infrastructure. The Customer may settle the total order value using the following authorized payment methods, subject to the specific terms of the issuing network : a) Credit and Debit Cards (Visa, Mastercard, etc.). b) Digital Wallets: Apple Pay, Google Pay, Revolut Pay. c) Link (by Stripe) for accelerated, one-click checkout. d) Account-to-Account (A2A) and Regional Banking Transfers:
  • BLIK and Przelewy24 (Poland).
  • MB WAY (Portugal).
  • Bancontact (Belgium).
  • EPS (Austria).
  • iDEAL | Wero (Netherlands / Pan-European) – Processed securely via instant account-to-account transfer utilizing biometric or banking app authentication.
  • Pix (Brazil) – Processed via QR code scanning or Pix string.
  • Standard SEPA / SWIFT Bank Transfers. e) Buy Now, Pay Later (BNPL): Klarna.
  1. Klarna Regulatory Disclosures (CCD2 Compliance): Customers utilizing Klarna are hereby informed that all credit assessments, checks, and financing decisions are executed solely by Klarna Bank AB. The Seller (NEVQ, info@nestrovia.com, +48451200203) acts solely as a retail merchant facilitating the transaction and not as a regulated credit broker.
  2. Payment Timelines: The Customer is obliged to complete the payment immediately upon checkout. For asynchronous methods (e.g., traditional Bank Transfer), payment must clear within 3 business days of placing the order. Failure to process payment via the selected Stripe gateway within this timeframe will result in the automatic cancellation of the order contract.
§ 6. Delivery, Logistics, and Bulky Freight
  1. The Seller facilitates аcross Europe shipping, subject to specific geographic and geopolitical exclusions.
  2. Given the physical nature of the Store's inventory (e.g., upholstered sofas, solid wood tables, heavy interior decor), delivery is legally and logistically categorized as "Bulky Goods Freight."
  3. Delivery costs are borne entirely by the Customer unless a specific, explicitly stated free-shipping promotion is active.
  4. The Seller is obligated to deliver Products free of physical and legal defects in accordance with the General Product Safety Regulation (GPSR).
  5. Delivery timelines vary fundamentally based on whether the Product is in-stock or custom-manufactured. Custom furniture fulfillment timelines (typically ranging from 4 to 12 weeks) are clearly indicated on the respective Product pages. The Customer acknowledges that bespoke manufacturing requires extended lead times.
§ 7. Statutory Warranty, Defects, and The Right to Repair
  1. The Seller is liable to the Consumer if the Product has a physical or legal defect, under the strict statutory warranty (rękojmia) rules stipulated in the Polish Civil Code and the Polish Consumer Rights Act.
  2. The Right to Repair (EU Directive Compliance): In strict compliance with the EU Directive on common rules promoting the repair of goods (applicable from July 31, 2026), the Consumer holds the explicit statutory right to request the repair of defective goods. a) The Seller prioritizes the repair of physical defects over replacement to promote sustainable consumption and reduce waste. b) If a repair is successfully executed under the statutory warranty, the legal guarantee period for the repaired Product is automatically extended by an additional period of 12 months. c) If a defect makes repair technically impossible, unsafe, or disproportionately expensive compared to total replacement, the Seller will formally inform the Consumer, and a replacement or proportionate refund will be issued.
  3. Complaints regarding defective goods must be submitted in writing via email to info@nestrovia.com. The complaint must contain a precise description of the defect, the date it was discovered, digital photographic evidence of the defect, and the Consumer's preferred resolution (repair, replacement, price reduction, or contract withdrawal).
  4. The Seller will formally respond to the Consumer's warranty complaint within 14 calendar days of its receipt. Failure to respond within this statutory timeframe constitutes an automatic legal acceptance of the Consumer's claim.
§ 8. Out-of-Court Dispute Resolution (ADR)
  1. The Consumer possesses the right to utilize out-of-court mechanisms for dispute resolution. Detailed information on access to these procedures, as well as the rules governing dispute resolution, are available at the offices and on the websites of county (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, and the Polish Office of Competition and Consumer Protection (UOKiK).
  2. The Seller declares their willingness to participate in proceedings for the out-of-court resolution of consumer disputes. The competent entity for Nestrovia is the appropriate Provincial Inspector of Trade Inspection (Wojewódzki Inspektor Inspekcji Handlowej) in Poland.
  3. Note on Digital Platforms: Consumers are advised that the European Online Dispute Resolution (ODR) platform has been permanently closed by the European Commission as of July 20, 2025. All disputes must be directed through national ADR frameworks as outlined above.
§ 9. Final Provisions
  1. The Seller reserves the right to amend these Terms and Conditions for vital legal, regulatory, or organizational reasons. Registered Customers will be notified of changes via email at least 14 days prior to the effective date.
  2. In matters not explicitly covered by these Terms and Conditions, the provisions of Polish national law shall apply unconditionally, specifically the Civil Code, the Consumer Rights Act, and applicable European Union Regulations. The application of the United Nations Convention on Contracts for the International Sale of Goods is explicitly excluded.
